1. Acceptance of Terms

Welcome to Dvelop AI (dvelopai.com). These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Dvelop AI ("Company," "we," "us," or "our"). By creating an account, accessing, or using the Dvelop AI platform, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree with any part of these Terms, you must not use our platform. We reserve the right to modify these Terms at any time. Changes become effective upon posting to this page. Your continued use of the platform after changes are posted constitutes your acceptance of the revised Terms.

You must be at least 18 years of age to use Dvelop AI. By using this platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement.

2. Description of Service

Dvelop AI is an AI-powered assistant platform that provides conversational AI capabilities, goal tracking, memory and context awareness, API integrations with third-party services (including social media and email), and credit-based usage management. The platform allows users to interact with various AI models through a unified interface and connect external accounts for enhanced functionality.

3. Account Registration

To use Dvelop AI, you must create an account by providing accurate and complete information. You may register using an email address and password, or through Google Sign-In. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring your account information remains accurate and up-to-date

We reserve the right to suspend or terminate accounts that contain false information, violate these Terms, or remain inactive for an extended period.

4. Subscription Plans and Pricing

Dvelop AI offers the following subscription tiers:

Business	$50/month	Enhanced features, priority model access, advanced integrations, and increased usage limits.
Enterprise	$100/month	Full platform access, premium model access, unlimited integrations, priority support, and custom configurations.

Prices are in US Dollars and do not include applicable taxes. We reserve the right to change pricing with 30 days' notice to existing subscribers. Price changes will take effect at the start of your next billing cycle.

5. Bring Your Own Key (BYOK)

Dvelop AI allows you to connect your own API keys from third-party AI providers (including but not limited to OpenAI, Anthropic, Google AI, and services accessed via OpenRouter). When using BYOK:

• You are solely responsible for all costs, charges, and usage incurred through your own API keys. Dvelop AI does not pay for, subsidize, or reimburse any third-party API costs associated with your keys.
• You must comply with the terms of service and acceptable use policies of your chosen AI provider(s).
• You are responsible for managing your API key quotas, rate limits, and billing with the respective provider.
• Dvelop AI is not liable for any overages, unexpected charges, or service disruptions caused by your API key usage, configuration, or provider outages.

5.1 API Key Storage

When you provide API keys to Dvelop AI, we store them using AES-256 encryption in our database. While we take reasonable measures to protect your keys:

• You are ultimately responsible for the security of your API keys.
• You should rotate your keys periodically and revoke any keys you suspect have been compromised.
• Dvelop AI will never share, sell, or use your API keys for any purpose other than processing your requests through the platform.
• You may delete your stored API keys from the platform at any time.

6. Data Storage and Security

Your data is stored using the following infrastructure:

• Primary data store: Supabase (PostgreSQL) with Row Level Security (RLS) enabled, ensuring that users can only access their own data.
• Sensitive data encryption: API keys, OAuth tokens, and other sensitive credentials are encrypted at rest using AES-256-GCM encryption.
• Account data: Core WordPress account information (username, email, password hash) is stored in the WordPress MySQL database.
• Data in transit: All communications are encrypted via HTTPS/TLS.

While we implement industry-standard security measures, no method of electronic storage or transmission is 100% secure. We cannot guarantee absolute security, and you acknowledge this risk by using the platform.

7. AI-Generated Content Disclaimer

You acknowledge and agree that:

• AI-generated content may be inaccurate, incomplete, biased, or misleading.
• Dvelop AI is not liable for any decisions, actions, or consequences resulting from reliance on AI-generated content.
• You are solely responsible for reviewing, verifying, and using AI outputs at your own discretion and risk.
• AI models are provided by third-party providers, and their behavior, capabilities, and limitations are beyond our direct control.
• We do not guarantee that AI outputs will be free from errors, biases, or harmful content.

8. Billing, Cancellation, and Refunds

8.1 Billing

Subscription payments are processed through Stripe. By subscribing, you authorize Stripe to charge your provided payment method on a recurring monthly basis. Billing occurs on the same date each month as your initial subscription date.

8.2 Cancellation

You may cancel your subscription at any time through your account dashboard or by contacting support. Upon cancellation:

• Your subscription remains active until the end of your current billing period.
• You retain access to all paid features until the billing period expires.
• After the billing period ends, your account will revert to a limited access state.
• Your data will be retained for 30 days following account downgrade, after which it may be deleted.

8.3 Refunds

Refund eligibility is determined as follows:

• Within 7 days of initial subscription: You may request a full refund if you have not made substantial use of the platform.
• After 7 days: Refunds are generally not provided for partial billing periods. Exceptions may be made at our sole discretion for documented service outages or billing errors.
• BYOK costs: We do not refund any costs incurred through your own API keys with third-party providers.

To request a refund, contact support@dvelopai.com with your account details and reason for the request.

9. Connected API Accounts

Dvelop AI allows you to connect third-party accounts and services, including but not limited to social media platforms (Facebook, Twitter/X, Instagram, LinkedIn), email services (Gmail), and other APIs. By connecting these accounts:

• You explicitly authorize Dvelop AI to access, read, and interact with data from these services on your behalf, within the scope of permissions you grant.
• You are responsible for understanding the permissions you are granting and the data that will be accessed.
• You may revoke access to any connected account at any time through your dashboard or through the third-party platform's settings.
• Dvelop AI stores OAuth tokens and connection metadata using AES-256 encryption.
• We access connected accounts only to provide the features you request (e.g., posting content, reading messages, managing schedules).
• You must comply with the terms of service of each connected third-party platform.

10. Intellectual Property

10.1 Your Content

You retain ownership of all content you create, input, or generate through your use of Dvelop AI, including conversations, goals, notes, and other user-generated content. By using the platform, you grant Dvelop AI a limited, non-exclusive license to process and store your content solely for the purpose of providing the service to you.

10.2 Platform Ownership

Dvelop AI and its licensors own all rights, title, and interest in the platform, including but not limited to the software, design, code, user interface, trademarks, logos, and documentation. Nothing in these Terms grants you any right, title, or interest in the platform beyond the limited right to use it in accordance with these Terms.

10.3 Feedback

If you provide suggestions, ideas, or feedback about the platform, you grant Dvelop AI a perpetual, irrevocable, royalty-free license to use, modify, and incorporate such feedback without any obligation to you.

11. Prohibited Conduct

You agree not to:

• Use the platform for any illegal, fraudulent, or harmful purpose
• Attempt to reverse engineer, decompile, or disassemble the platform
• Circumvent security measures, rate limits, or access controls
• Share, resell, or sublicense your account access
• Use the platform to generate spam, malware, or harmful content
• Harass, abuse, or threaten other users or our staff
• Upload content that infringes on the intellectual property rights of others
• Use automated tools to scrape, crawl, or extract data from the platform without written authorization

12. Termination

Termination by you: You may terminate your account at any time by canceling your subscription and requesting account deletion through your dashboard or by contacting support@dvelopai.com.

Termination by us: We may suspend or terminate your account at any time, with or without cause, including but not limited to violations of these Terms, the Acceptable Use Policy, or any applicable law. We will make reasonable efforts to provide notice before termination, except in cases of severe violations.

Effect of termination: Upon termination:

• Your right to access the platform ceases immediately (or at the end of your billing period, if applicable).
• We will retain your data for 30 days following termination, during which you may request a data export.
• After 30 days, all your data — including conversations, goals, memory data, stored API keys, and connected account tokens — will be permanently deleted.
• We are not obligated to provide any data after the 30-day retention period.

13. Limitation of Liability

To the maximum extent permitted by applicable law:

• Dvelop AI is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory.
• We disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, non-infringement, and accuracy of AI-generated content.
• In no event shall Dvelop AI, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill.
• Our total aggregate liability for any claims arising from or related to these Terms or the platform shall not exceed the total amount you paid to Dvelop AI in the twelve (12) months immediately preceding the event giving rise to the claim.
• We are not liable for any damages resulting from third-party AI provider outages, API key misuse, data breaches caused by your negligence, or actions taken based on AI-generated content.

14. Indemnification

You agree to indemnify, defend, and hold harmless Dvelop AI and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the platform, your violation of these Terms, your use of BYOK API keys, or your infringement of any third-party rights.

15. Dispute Resolution

Any disputes arising from or relating to these Terms shall first be addressed through good-faith negotiation. If the dispute cannot be resolved informally within 30 days, either party may pursue resolution through binding arbitration in accordance with the rules of the American Arbitration Association. Class action lawsuits and class-wide arbitration are not permitted.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. You consent to the exclusive jurisdiction of the federal and state courts located in Delaware for any legal proceedings arising from these Terms.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed. The remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and Acceptable Use Policy, constitute the entire agreement between you and Dvelop AI regarding the use of the platform and supersede all prior agreements and understandings.
